Terms of Service

These Terms govern your use of Bot Dynamics AI (the "Services"), a brand operated by Tourify FZC (Sharjah, UAE) in partnership with Pixel Analytics LLC (Delaware, USA) — collectively "we," "us," "our." By using the Services you agree to these Terms.

1. Services

Bot Dynamics AI provides AI-powered chat, voice, and messaging tools to businesses ("Clients"). End users interact with these tools when contacting a Client. The Client is responsible for the chatbot's content and disclosures to their users.

2. Acceptable Use

You must not use the Services to:

• Violate any law, regulation, or third-party rights.
• Send unlawful, harassing, fraudulent, or spam content.
• Attempt unauthorised access to our systems.
• Reverse-engineer or disassemble any component of the Services.
• Violate Meta's WhatsApp Business Policy or any other platform policy.

We may suspend or terminate access for violations without notice.

3. Service Availability

The Services are provided on a best-effort basis with no guarantee of uptime. No SLA is offered unless separately agreed in writing. We may suspend for maintenance or security with or without notice.

4. Intellectual Property

All rights in the Bot Dynamics AI platform are owned by or licensed to Tourify in partnership with Pixel Analytics LLC. You retain rights to content you submit; you grant us a limited licence to process it solely to provide the Services per our Privacy Policy.

5. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. AI-GENERATED RESPONSES MAY BE INACCURATE. DO NOT RELY ON THEM FOR MEDICAL, LEGAL, OR FINANCIAL DECISIONS.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOURIFY FZC AND PIXEL ANALYTICS LLC SHALL NOT BE LIABLE FOR INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF AMOUNTS YOU PAID IN THE PRIOR 12 MONTHS OR USD $100.

7. Indemnification

You agree to indemnify Tourify FZC and Pixel Analytics LLC from claims arising from your violation of these Terms, applicable law, or content you submit.

8. Third-Party Platforms

Use of integrated platforms is subject to their own terms: WhatsApp Terms · Meta Terms. We are not responsible for third-party platforms.

9. Termination

We may terminate access at any time for violations, legal requirements, or service discontinuation. Sections 5, 6, 7, 10, and 11 survive termination.

10. Governing Law

These Terms are governed by the laws of Delaware, USA. Disputes shall be resolved by binding AAA arbitration in Delaware; class actions are waived. Disputes related to Meta platform services may also be subject to the laws of Sharjah, United Arab Emirates, where Tourify FZC is registered.

11. Changes

We may update these Terms at any time. Continued use after posting constitutes acceptance.
